DMCA Policy for Love Rosie

Love Rosie is committed to respecting the intellectual property rights of others and expects its users to do the same. This DMCA (Digital Millennium Copyright Act) Policy outlines the procedures for copyright owners to report alleged copyright infringement and for users to submit counter-notifications when their content has been removed due to a copyright complaint.

It is our policy to respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA). Upon receipt of a valid and complete DMCA notice, we will remove or disable access to the allegedly infringing material and take reasonable steps to notify the user who posted the content.

Filing a DMCA Notice of Copyright Infringement

If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Love Rosie website, you may notify our designated Copyright Agent, as set forth below. For your complaint to be valid under the DMCA, you must provide the following information in writing:

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
  2. A description of the copyrighted work that you claim has been infringed, including the URL where the copyrighted work was published (if available) or a copy of the copyrighted work.
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit Love Rosie to locate the material (e.g., URL(s) of the allegedly infringing content on our site).
  4. Information reasonably sufficient to permit Love Rosie to contact you, such as your address, telephone number, and, if available, an electronic mail address.
  5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law.
  6. A statement, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a DMCA Counter-Notification

If your content has been removed or disabled as a result of a DMCA notice, and you believe that the content was removed or disabled by mistake or misidentification, you may send a counter-notification to our designated Copyright Agent. To be effective, a counter-notification must be a written communication that includes the following:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled and the location (URL(s)) at which the material appeared before it was removed or access to it was disabled.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Love Rosie may be found, and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
